A Brief Introduction to the Trademark Manual of Examining Procedure (TMEP)
There are several sides of practicing trademark law. Often, we oversimplify and parse the practice into litigation and prosecution. I enjoy practicing in both areas because they complement each other. I can better advise my prosecution clients (e.g., clients looking to register their trademarks) if I know how a prosecution decision will improve the client’s enforcement efforts or potentially harm them in future litigation. Likewise, I am better suited to avoid a litigation strategy that might harm the client’s overall portfolio/prosecution strategy.
Assisting clients with trademark prosecution requires not only familiarity with, but expertise in the TMEP. The TMEP stands for the Trademark Manual of Examining Procedure. It is a comprehensive guidebook published by the United States Patent and Trademark Office (USPTO) that provides guidance and instructions for examining trademark applications and determining the registrability of trademarks in the United States.
The TMEP covers a wide range of topics related to trademark examination, including the criteria for registrability, the application process, evidence of use requirements, trademark specimens, descriptions of goods and services, trademark classification, and many other important aspects of trademark law and practice. It consists of numerous rules, references, and annotations to trademark law.
